What is The Ruling on Sleeping the Nights of Tashreeq Outside of Mina?

Question

I have performed Hajj (Islamic pilgrimage) in the year 1998 from Al-Quway’iyyah with someone who owns a car. However, the owner of the car was ignorant of the rituals of Hajj in terms of the roads, and with great regret, we spent the three days of Mina in Al-Hawdh in Mecca. We spent the nights of Mina in this place and slaughtered our sacrifice. So, is there anything upon us regarding this? Note: we were not able to reach Mina. I hope you can present this problem to one of the sheikhs. So, what is the obligatory kaffarah (expiation) upon us? And are we excused? I ask Allah to grant everyone happiness, goodness, and success.

As for their slaughtering of the sacrifice there, it is okay. That’s because it is permissible to slaughter in Mina, Makkah, and all areas of the Haram. As for them staying three days in that place, if it is as he described that he was unable to reach Mina, there is nothing upon them regarding this. However, if they were negligent, they neither searched nor investigated this matter, then they have made a great mistake. It is obligatory upon a Muslim to take precautions concerning his religion, and keep searching until he truly is incapable (of it). So, if he is truly incapable, “Allah the Exalted doesn’t burden a person beyond his scope.” [Surah Al-Baqarah 2:286] And the scholars have said, based on this Noble Ayah, that there is no obligation when there is incapability. Next question: This is a message received from the sender, Murshid… The Sheikh: Hold on, I think that the questioner understands now that there is nothing upon them and there is no kaffarah (expiation) obligatory upon them. Rather, it is only obligatory upon them to take precautions in the future.
