It's Best to Bequeath One-Fifth

And he (ﷺ) said, "One-third, and one-third is (still) a lot" or he (ﷺ) said, "... it is big" (i.e., as a charity from the wealth of the deceased). And there is evidence in this that if it is less than one-third, it is better and more complete. Therefore, Ibn ‘Abbas said, “If people would reduce from third to fourth (part for making a will of their property), for Allah's Messenger (ﷺ) said: So far as the third (part) is concerned, it is quite substantial.” And Abu Bakr said: "I am pleased with what Allah is pleased for Himself", meaning the fifth, so he bequeathed the fifth, may Allah be pleased with him. And by this, we know that what people do today, and the fact that they bequeath one-third is contrary to what’s preferred, although it is permissible. However, it’s best to be less than one-third, either a quarter or a fifth. Our Fuqaha (scholars of Islamic Jurisprudence), may Allah have mercy on them, said that it is better for him to bequeath a fifth, not exceeding it, following the example of Abu Bakr Al-Siddiq, may Allah be pleased with him.
